The terms and conditions forms an agreement between you (referred to as “you”, “your” or the “Customer” herein) and Kash4me Corp. with its registered office at 202 Zinnia way, Ottawa, Ontario, Canada, K4M0L4 (referred to as “Kash4me”, “we” or “us”) as the owner of this website and Kash4me App.
Conditions of use
By using this website or Kash4me App, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website or Kash4me App accordingly. Kash4me only grants use and access of this website or Kash4me App, its products, and its services to those who have accepted its terms.
Privacy policy
Before you continue using our website or Kash4me App, we advise you to read our privacy policy regarding our user data collection. It will help you better understand our practices.
Age restriction
You must be at least 18 (eighteen) years of age before you can use this website or Kash4me App. By using this website or Kash4me App, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. Kash4me assumes no responsibility for liabilities related to age misrepresentation.
Intellectual property
You agree that all materials, products, and services provided on this website or Kash4me App are the property of Kash4me, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute the Kash4me’s intellectual property in any way, including electronic, digital, or new trademark registrations.
You grant Kash4me a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.
User accounts
As a user of this website or Kash4me App, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address it accordingly.
We reserve all rights to terminate accounts, edit or remove content if necessary.
We provide you the way to delete your account permanently from our system so that your information will no longer be with us.( conditions may apply before deletion of account)
Programs
Our members earn/accumulate cash back (“Cash Back”) on every purchases from the registered merchants. Kash4me allows merchants to set the purchase limit for the customers. We receive compensation and cash back amount from the merchants after they meet the self-set purchase limit from every customer. We pay customers the cash back amount received from merchants (set by the merchants) whenever customer requests for money withdrawal.
Fees and Payments
Registration is totally free for merchants and customers. The Merchants only have to pay the decided Service Fee as mentioned in website or app. Kash4me will ask to pay to the Kash4me bank account through third party payment processor and will ask for consent to set up pre-authorized ( recurring) payment setup if required. Any additional charges caused due to insufficient funds will be the responsibility of the respective account holder.
Payable amount will be billed to Business user via email and invoiced amount are due within 2-3 business days. In the event of non – receipt of the billed amount, Kash4me bears no liability to compensate the customer. Merchants are accountable for any legal and business risks arising from payment delays.
Charges paid by you are final and non-refundable. Kash4me has no obligation to provide refund or credits, but may grant them, in each case in Kash4me’s sole discretion.
Regular users ( non-business user) will receive the payment only after Kash4me receives payment from Merchants. Users do not have to pay any service Fee but upon request of money withdrawal, certain Transaction Fee may apply.
Kash4me may change the fees that is being charged to you as we deem necessary or appropriate for our business, including but not limited to Service Fees and Transaction Fees.
All fees owed by merchant in connection with this Agreement are inclusive of taxes.
Applicable law
By visiting this website or Kash4me App, you agree that the laws of the Canada and USA, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Kash4me and you, or its business partners and associates.
Third Party Services and Content
You acknowledge that different terms and privacy policies may apply when Kash4me Services are available or accessed through third party services and content like Google adds or any means of advertisement that Kash4me doest not control.
You acknowledge and agree that the availability of the Application(“App”) may be dependent on the third party from which you received the App’s license, e.g., the Apple app stores or Android app stores (“App Store”). You acknowledge and agree that these Kash4me Terms are between you and Kash4me and not with the App Stores and that Kash4me is responsible for the provision of the Kash4me Services as described in these Kash4me Terms. However, you acknowledge and agree that if you access the Kash4me Services using Apps developed for Apple iOS, and Android, Apple Inc. (“Apple”), Google, respectively, are third-party beneficiaries of these Kash4me Terms. In order to use the App, you must have access to a internet, and you agree to pay all fees associated with such access. You also agree to pay all fees (if any) charged by the App Store in connection with the App or the Services. You agree to comply with, and your license to use the App is conditioned upon your compliance with, all applicable third-party terms of agreement (e.g., the App Store’s terms and policies) when using the App.
Ownership
The Kash4me Services and all rights therein are and shall remain Kash4me’s property or the property of Kash4me’s licensors. Neither these Kash4me Terms nor your use of the Kash4me Services convey or grant to you any rights: (i) in or related to the Kash4me Services except for the limited licence granted above; or (ii) to use or reference in any manner Kash4me’s company names, logos, product and service names, trademarks or services marks or those of Kash4me’s licensors.
Copyrights
All intellectual property rights such as all copyright, patents, trademarks, trade names, designs, information, database, text and graphics, software, photos, video, music, sound, shall remain our property or that of their respective owners. None of the material on our website or app may be reproduced or copied, distributed, republished, downloaded, displayed, sold or in any way exploited without our prior express permission. All rights in the product and company names mentioned on the website are the trademarks or registered trademarks of their respective owners. All comments, suggestions, ideas, notes, drawings, concepts or other information: (i) disclosed or offered to us by you; or (ii) in response to solicitations by us regarding the our Services or the Website or app; (in each foregoing case, these are called “Ideas”) shall be deemed to be and shall remain our property and you hereby assign by way of present and future assignment all intellectual property rights in ideas, to us.
Restrictions
You agree that you will not and will not permit others to : (i) remove any copyright, trade mark or other proprietary notices from any portion of the Kash4me Services or website or app; (ii) access the Program or the Company Properties by expert system, electronic agent, “bot” or other automated means; (iii) reproduce, modify, reverse engineer, reverse assemble, decompile, copy or otherwise derive the source code of any Company Property for any reason; (iv) use scripts or disguised redirects to derive financial benefit from Company; (v) link to, mirror or frame any portion of the Kash4me Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Kash4me Services or its related systems or networks.
Communication with Kash4me
By creating a Kash4me account, you electronically agree to accept and receive communications from Kash4me, or third parties providing services to Kash4me including via email, text message, calls, and push notifications to the cellular telephone number you provided to Kash4me. Message and data rates may apply. If you do not wish to receive promotional emails, text messages, or other communications, you may change your notification preferences by accessing the Settings in your account.
Disputes
Any dispute related in any way to your visit to this website or Kash4me App shall be arbitrated by state or federal court Canada or USA and you consent to exclusive jurisdiction and venue of such courts.
Indemnification
You agree to indemnify Kash4me and its affiliates and hold Kash4me harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on liability
Kash4me is not liable for any damages that may occur to you as a result of your misuse of our website or Kash4me App.
Kash4me reserves the right to edit, modify, and change this Agreement any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between Kash4me and the user, and this supersedes and replaces all prior agreements regarding the use of this website or Kash4me App.
